Payment Data. We may collect data necessary to process your payment if you make purchases, such as your payment instrument number and the security code associated with your payment instrument. All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Understanding Your Personal/Mental Health Information
A record of your visit is made each time you meet with a member of our staff at Light Counseling. Typically, this record contains your service needs, plans for future services, symptoms, diagnosis, treatment, and plans for future care or treatment. This information is referred to as your Counseling Record and serves as a:
- Basis for planning your services and treatment.
- Means of communication among the professionals who contribute to your care
- Legal document describing the services you received
- Means by which you or a third-party payer can verify that services billed were actually provided
- A tool in educating professionals
- A source of data research
- A source of information for public health officials charged with improving the overall well-being and mental health of this state and the nation
- A source of data for planning and marketing
- A tool with which we can assess and continually work to improve the services we render and the outcomes we achieve
Understanding what is in your record and how this information is used helps you to a) ensure its accuracy; b) better understand who, what, when and why others may access your information; and c) make more informed decisions when authorizing disclosures to others.
Although your Counseling Record is the physical property of Light Counseling, the information belongs to you. You have the right to:
- Obtain a paper copy of this notice of information practices on request.
- Inspect and receive a copy of your Counseling Record as provided for in 45 CFR 164.524;
- Amend your record as provided in 45 CFR 164.528;
- Obtain an accounting of disclosures of your information as provided in 45 CFR 164.528;
- Request communications of your information by alternative means or at an alternative location;
- Request a restriction on certain uses and disclosures of your information as provided by 45 CFR 164.522; and
- Revoke your authorization to use or disclose information except to the extent that action has already been taken.
Examples of Disclosures for Treatment, Payment, and Service Operations
- We will use your personal information for treatment.
For Example: Information obtained by a Counselor or other member of your program team will be recorded in your record and used to determine the course of services/treatment that should work best for you. Your provider will record his/her expectations, actions taken, and observations in your record. That way, they will know how you respond to services/treatment. We will also provide your subsequent service provider with copies of various reports that should assist him or her with your services/treatments.
2. The Light Counseling will use your personal information for payment.
For Example: A bill may be sent to a third-party payer. The information on or accompanying the bill may include information that identifies you and your diagnosis (if applicable) and treatment.
3. Light Counseling will use your personal information for regular service operations.
For Example: Members of the Light Counseling staff, risk or quality improvement manager, or members of the quality improvement team may use information in your record to assess the services and outcomes in your case and others like it. This information will then be used to continually improve the quality and effectiveness of the care and services we provide.
4. Other examples:
- Business Associates: There are some services provided in our organization through contact with business associates. Examples include Collection Agencies, Auditors, etc. When these services are contracted, we may disclose your personal information to our business associates so that they can perform the job we’ve asked them to do and bill you or your third-party payer for services rendered. To protect your personal information, however, we require the business associate to appropriately safeguard your information.
- Notification: We may use or disclose your information to notify a family member, personal representative, or person responsible for your well-being, about services provided; your location, and general condition. We may leave a message on your answering machine or voicemail as a means of communication. We may mail you a postcard or written notice as a means of communication
- Communication with Family: Service Providers/Counselors, using their best judgment, may disclose to a family member, other relative, friend or any other person you designate, personal information relative to that person’s involvement in services provided to you or payment related to these services.
- Workers Compensation / Disability: We may disclose personal information to the extent authorized by and to the extent necessary to comply with laws relating to workers compensation or other similar programs established by law.
- Public Health: As required by law, we may disclose your health information to public health or legal authorities charged with preventing or controlling disease, injury or disability.
- Courts of Law OR Law Enforcement: We may disclose health information for law enforcement purposes as required by law or in response to a valid subpoena.
Federal law makes provisions for your personal/mental health information to be released to an appropriate oversight agency, public health authority or attorney, provided that a work force member or business associate believes in good faith that we have engaged in unlawful conduct or have otherwise violated professional or clinical standards and are potentially endangering one or more clients, workers or the public.

If you have questions and would like additional information, you may contact Light Counseling. If you believe your privacy rights have been violated, you can file a complaint with Light Counseling or with the Office of Civil Rights, U.S. Department of Health and Human Services. Grievance Procedure
If you have any questions relating to your rights as a client of Light Counseling, or if you have concerns about your relationship with Light Counseling, the following steps may be taken:
- Discuss your concerns with the provider you have been working with.
- If this does not result in a satisfactory resolution, write a letter documenting your concerns to the Business Director, Clinical Director, and/or Compliance Officer at Light Counseling and mail it to: Light Counseling, 1075 Light Boulevard, Forest, VA 24551.
- You will be notified that your letter has been received and an investigation will be conducted.
- The Owner or their legal representative will make an independent judgment and has the authority to alter aspects of your relationship with the agency.
- Within an agreed-upon time, you will be notified that your complaint has been handled. Within boundaries permitted by law, you will be informed of the resolution of your complaint.
